By accessing or using the FamPhone AI platform, website at famphoneai.com, mobile interface, TapTag wearable products, or any related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not access or use the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and FamPhone AI LLC ("FamPhone," "we," "us," or "our"), a limited liability company organized under the laws of the State of Illinois.
By creating an account, tapping a TapTag wearable, or otherwise using the Service, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
FamPhone AI provides a peer-to-peer family communication platform that enables users to initiate live encrypted video calls in crisis situations. Core features include:
FamPhone is a supplemental family safety communication tool. It is expressly not a monitoring service, not an emergency dispatch service, and not a medical alert system. We do not listen to, record, or store your video calls unless you expressly enable the Premium recording feature.
You must be at least 18 years of age to create a FamPhone account. By registering, you represent and warrant that you are 18 years of age or older.
FamPhone accounts may be created on behalf of minor family members (under 18) by a parent or legal guardian who accepts these Terms on their behalf. The parent or guardian is solely responsible for the minor's use of the Service and compliance with these Terms.
The Service is intended for personal, non-commercial family use. Any commercial use requires prior written consent from FamPhone AI LLC.
The Service is available in the United States and select international markets. We make no representation that the Service is appropriate or legally available in all jurisdictions. Users accessing the Service from outside the United States do so at their own risk and are responsible for compliance with local laws.
To use core features of the Service, you must register by providing your first name, phone number, and optionally your email address. You agree to provide accurate, current, and complete information and to update it as necessary.
Upon registration, FamPhone generates a unique personal URL (e.g., famphoneai.com/firstname_xxxx) that serves as your family connection point. This link is tied to your phone number. You are responsible for keeping your unique link private and sharing it only with trusted family members.
You are responsible for all activity that occurs under your account. FamPhone is not liable for any loss or damage arising from your failure to maintain the security of your account or unique link. Notify us immediately at legal@famphoneai.com if you suspect unauthorized use of your account.
Each phone number may be associated with one FamPhone account. Creating duplicate accounts is prohibited and may result in account suspension.
The Free Plan provides access to core features at no charge, including peer-to-peer encrypted video calls, TapTag wearable compatibility, SMS and email contact alerts, real-time location sharing, and up to five registered family contacts. The Free Plan is provided "as is" with no uptime or availability guarantee.
The Premium Plan is a paid subscription that adds AI-powered features including Gemini AI crisis intelligence and live coaching, 4K video analysis, session recording to secure cloud storage, unlimited family contacts, FamPage real-time family dashboard, and priority support. Pricing is displayed at famphoneai.com/premium-signup.html and is subject to change with 30 days' notice.
Premium subscriptions are billed monthly or annually in advance. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. You authorize FamPhone to charge your payment method on file for all fees incurred. All fees are in US dollars and are non-refundable except as required by applicable law.
FamPhone may offer free trial periods for Premium features. At the end of the trial period, your subscription will automatically convert to a paid plan unless cancelled before the trial ends. We will provide notice before charging.
We reserve the right to modify Premium pricing. We will provide at least 30 days' prior notice of any price increase. Continued use of the Premium Plan after the effective date of a price change constitutes acceptance of the new pricing.
TapTag wearables (including wristbands, badges, and backpack tags) are NFC-enabled physical products sold separately through the FamPhone store. Purchase of a TapTag is subject to separate purchase terms presented at checkout.
Each TapTag must be programmed (linked) to your unique FamPhone URL before use. Programming instructions are provided at time of purchase and on request. FamPhone is not responsible for TapTag devices that are incorrectly programmed or linked to an incorrect URL.
TapTag wearables require a compatible NFC-enabled device to initiate a call. Functionality depends on the receiving family member's device having network connectivity. FamPhone is not liable for failed connections due to network outages, NFC incompatibility, or device limitations.
TapTag wearables carry a 90-day limited warranty against manufacturing defects from the date of purchase. This warranty does not cover damage from misuse, water damage beyond rated waterproofing, or normal wear and tear. Contact legal@famphoneai.com for warranty claims.
Unused, unlinked TapTag wearables may be returned within 30 days of purchase for a full refund. Once a TapTag has been programmed and linked to a FamPhone account, it is non-returnable.
Premium accounts have access to AI-powered features powered by Google's Gemini AI model. During an active crisis session, video frames may be transmitted to Gemini for real-time scene analysis, emotional state assessment, and coaching guidance. By using AI features, you consent to this processing.
AI-generated analysis, coaching suggestions, and recommendations are informational only. They are not medical advice, legal advice, or professional crisis counseling. Always follow the guidance of qualified emergency responders and professionals. FamPhone expressly disclaims any liability for actions taken in reliance on AI-generated output.
Video frames processed by AI features are transmitted securely and are not stored by FamPhone beyond the duration of the active session unless you have enabled session recording. AI processing is governed by Google's AI privacy terms in addition to our own Privacy Policy. We do not use your video content to train AI models.
AI features require internet connectivity and are subject to availability of third-party AI services. FamPhone does not guarantee the availability, accuracy, or response time of AI features and is not liable for AI service downtime or errors.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
FamPhone reserves the right to immediately suspend or terminate accounts that violate these acceptable use provisions, without prior notice, at our sole discretion.
FamPhone collects the personal information you provide at registration (name, phone number, email address), usage data, device information, and location data during active sessions (with your consent). We do not sell your personal data to third parties.
By registering with FamPhone, you consent to receive SMS and email notifications related to your account and service activity. You may opt out of marketing communications at any time by contacting legal@famphoneai.com. Transactional messages (account, session alerts) cannot be opted out of while your account is active.
By providing your phone number, you expressly consent to receive automated text messages from FamPhone at that number. Message and data rates may apply. You may opt out by replying STOP to any SMS. You may also opt in again by replying START.
California residents have rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to delete your data, and the right to opt out of the sale of personal information (note: we do not sell personal information). FamPhone does not knowingly collect personal information from children under 13 without verifiable parental consent. If you believe we have inadvertently collected information from a child under 13, contact us immediately at legal@famphoneai.com.
We retain your account data for the duration of your account and for up to 24 months following account deletion, as required for legal and business purposes. Session recordings (Premium) are retained for 90 days and then permanently deleted unless you download them first.
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, button icons, images, audio clips, software, and the compilation thereof — are the exclusive property of FamPhone AI LLC or its licensors and are protected by United States and international intellectual property laws.
The FamPhone name, FamPhone AI logo, TapTag name, and related marks are trademarks of FamPhone AI LLC. You may not use these marks without prior written consent.
You retain ownership of any content you submit through the Service. By submitting content, you grant FamPhone a non-exclusive, royalty-free, worldwide license to use, process, and transmit that content solely for the purpose of providing the Service to you.
Nothing in these Terms transfers any intellectual property rights to you. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Service without our prior written consent.
FAMPHONE IS NOT AN EMERGENCY SERVICE AND IS NOT A SUBSTITUTE FOR EMERGENCY SERVICES SUCH AS 911. FAMPHONE DOES NOT DISPATCH EMERGENCY RESPONDERS. IN ANY SITUATION INVOLVING RISK TO LIFE, CONTACT EMERGENCY SERVICES IMMEDIATELY.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. FAMPHONE DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED.
The Service depends on internet connectivity, device compatibility, and third-party infrastructure (including cellular networks, AWS cloud services, and Google AI services). FamPhone is not responsible for failures caused by network outages, device incompatibility, third-party service failures, or factors outside our reasonable control.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FAMPHONE AI LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL FAMPHONE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FAMPHONE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless FamPhone AI LLC and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
FamPhone reserves the right to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.
You may close your FamPhone account at any time by contacting us at legal@famphoneai.com. Account closure takes effect within 5 business days. Prepaid Premium subscription fees are non-refundable upon voluntary termination.
FamPhone reserves the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason including but not limited to violation of these Terms, non-payment of fees, conduct that is harmful to other users or to FamPhone, or legal requirements.
Upon termination: your right to use the Service immediately ceases; your account data will be deleted in accordance with our data retention policy; any TapTag wearables linked to your account will cease to function for call initiation. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, disclaimers, indemnification, and limitation of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before filing any formal legal claim, you agree to attempt to resolve the dispute informally by contacting FamPhone at legal@famphoneai.com. FamPhone will attempt to resolve the dispute within 30 days of receiving written notice.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as prohibited by applicable law. The arbitration shall take place in Chicago, Illinois, and shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AGREE THAT ANY CLAIMS WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR ARBITRATION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
For any claims not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.
Any claim arising under these Terms must be brought within one (1) year of the date the claim first arose, or it is permanently waived and barred.
FamPhone reserves the right to update or modify these Terms at any time. When we make material changes, we will notify you by email (if you have provided one), by SMS, or by posting a prominent notice on the Service, at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may close your account.
